BREAKING: SCOTUS Overturns Chevron Deference

The Supreme Court returned power to the individual.

The Supreme Court ruled 6-3 to overturn the 1984 decision in Chevron v. Natural Resources Defense Council. As Chief Justice John Roberts explained, Chevron “defies the command” of the Administrative Procedure Act.

Chevron is a 1984 Supreme Court case that produced the “Chevron deference,” a court-made rule giving massive power to administrative agencies. If the meaning of a statute is challenged and the language is “unambiguous,” that meaning is applied. But what if a court finds the words produce ambiguity in their meaning? The Chevron rule meant that it had to give extra weight to what an executive agency thought the real meaning was. That is now over.
