Federal Judge Steps Back From the Abyss and Refuses to Block Musk and DOGE From 7 Federal Agencies – Def-Con News

D.C. District Court Judge Tanya Chutkan has turned away an attempt by a coalition of 13 Leftist-run states that would have prevented Elon Musk or any of his DOGE team from accessing data or code at seven federal agencies.

Chutkan wrote in a ten-page decision:

[T]he court finds Plaintiffs have not carried their burden of showing they will suffer imminent, irreparable harm absent a temporary restraining order, and therefore Plaintiffs’ motion is DENIED.

The crux of the case brought before Chutkan is that Musk’s participation in government is illegal as the U.S. Senate has not confirmed him as a “principal officer” as required by Article II, Section 2, Clause 2 or the Constitution and Congress does…
